Obtain A Police Report
It is the policy of Whitehall Borough Police Department to conform to the mandates of the Pennsylvania Vehicle Code, 75 Pa.C.S. §§ 101 et seq., the Criminal History Record Information Act, 18 Pa. C.S.A. § 9101 et seq. (CHRIA), the Pennsylvania Right to Know Law, 65 P.S. §§ 67.101, et seq (RTKL), and Act 22 of 2017, 42 Pa.C.S. §§ 67A01 et seq. (Act 22). Depending on the type of record and your relationship to the case, copies of police reports and other police records may or may not be available under certain circumstances:
Motor Vehicle Accident report copies are only available to involved parties. There is a $15 fee for each report copy and you must include a copy of your photo ID. We will NOT release a full copy of the report if criminal charges are pending. Click to download and complete the Police Accident Report Request Form. Police Incident Reports must be requested under the Pennsylvania Right-to-Know Law (RTKL). Police incident reports containing criminal investigatory material will not be released in accordance with CHRIA and Section 708(b)(16) of the RTKL. Criminal police incident reports can only be released to criminal justice agencies like criminal courts and other police departments and are generally not available pursuant to a civil subpoena under CHRIA. However, “police blotter” information is a public record and will be released.
Police incident reports containing noncriminal investigatory material (e.g., child custody and civil disputes) are not public records under Section 708(b)(17) of the RTKL and will not be released unless the release is not prohibited by law or court order and the Department determines that it is in the public interest to release the record. Noncriminal police incident reports are generally available pursuant to a civil subpoena.
